Subject: 9895 1993-100 Memorial Hospital Date: Mon, 27 Feb 1989 12:20:00 -0500 Revised by Ordinance #9997 1993-100 Memorial Hospital ORDINANCE NO. 9895 AN ORDINANCE CLOSING AND ABANDONING CITICO AVENUE LOCATED NORTHWEST FROM GLENWOOD DRIVE, SOUTHWEST OF ROBBINS STREET MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Citico Avenue located northwest from Glenwood Drive, southwest of Robbins Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Citico Avenue, a 50 foot wide right-of-way beginning on the southeast line of North Chamberlain Avenue 299.99 feet southwest of the intersection of the southeast line of North Chamberlain Avenue with the southwest line of Robbins Street, and extending southeastwardly some 971.11 feet between parallel lines to the northwest line of Glenwood Drive, being the new Citico Avenue right-of-way as dedicated on the Corrective Plat, Revised Plan of Lot 1-Block A, Lot 2-Block B, and Realignment of Citico Avenue, Engleside Subdivision, as shown by plat of record in plat book 46, page 101, ROHC. Tax Map No. 146E-D-1, and 146E-E-1 and 11. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for the Tennessee-American Water Company of an easement the width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way. 2. The Electric Power Board of Chattanooga has distribution facilities located within said right-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 3. Reservation of an easement the width of the right-of-way for South Central Bell for the purpose of operating and maintaining its facilities in said right-of-way. 4. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 5. The reservation of an easement the width of the right-of-way for Chattanooga Cable TV Company for the purpose of operating and maintaining its facilities in said right-of-way. 6. The areas reserved for utility easements must be kept free and clear of all structures. 7. Subject to widening of the northbound approach of Glenwood Drive at Robbins Street to provide a separate left-turn lane and uprading the turning radii to a minimum of 25 feet for the southwest corner of Glenwood Drive at Robbins Street, the southeast corner of North Chamberlain at Robbins Street and the northwest corner of North Chamberlain/Derby Street at Citico Avenue. 8. All existing easements are retained. SECTION 3.
